An uncontested divorce simply means that you and your spouse have resolved any issues you may have related to your property, money, bills and kids if you have any. Because you have worked these things out between yourselves, you don't need to go to court and have a judge decide these things. You just need an attorney to prepare the paperwork for a judge's approval.

The longer you have been married, the more issues you are likely to need to resolve. Conversely, if you haven't been married very long, you may not have any issues to work out. If you can answer yes to each of the following questions, you should be able to obtain a divorce simply by signing the necessary paperwork.
 
1. Does each person have in his or her possession the personal property (clothes, furniture, appliances, etc.) he or she is going to receive?
 
2.  If you have outstanding debts (credit cards, loans, etc.), have you decided who is going to pay which bills?
 
3.  If you have minor children, have you decided who the kids are going to live with and how much child support will be paid to the custodial parent for the kids? (please check the child support formulator for an approximation of the child support obligation)
 
4.  Will both parties sign the papers?  This is the key to an uncontested divorce.  If you know that your spouse is not going to agree to something or anything and is not going to sign anything, you can still obtain a divorce, but you will have to go to court. Call me to discuss your options.
